This work is about current theories concerning the application of the constitutional rules, on the approach of the efficacy and effectiveness of the fundamental rights. It also suggests an alternative way of logical analysis of the problem, mainly taking in account the phenomena of the application-efficacy-effectiveness of the rules. Therefore, it discusses the dogmatic rules and proposes the logical separation between its applicability and its effectiveness, considering the effectiveness as the potential power to realize the fundamental rights.

Moral education through service learning at post-secondary level is an important but under-researched field. Most existing studies center on its learning outcomes like academic progress, personal development, communication, and leadership skills, with only a few evaluating the moral development of college students participating in service-learning projects. The lack of study on moral development in service learning indicates a need for clarification of the theoretical underpinnings of service learning, John Dewey's ideas on moral growth, in particular his model of moral imagination (...) and the implications thereof, for current service-learning research and practice. Some ways of defending inequality against the charge that it is unjust require premises that egalitarians find easy to dismiss—statements, for example, about the contrasting deserts and/or entitlements of unequally placed people. But a defense of inequality suggested by John Rawls and elaborated by Brian Barry has often proved irresistible even to people of egalitarian outlook. The persuasive power of this defense of inequality has helped to drive authentic egalitarianism, of an old-fashioned, uncompromising kind, out of contemporary political philosophy. 1. The present paper is a continuation of my “Self-Ownership, World Ownership, and Equality,” which began with a description of the political philosophy of Robert Nozick. I contended in that essay that the foundational claim of Nozick's philosophy is the thesis of self-ownership, which says that each person is the morally rightful owner of his own person and powers, and, consequently, that each is free to use those powers as he wishes, provided that he does not deploy them aggressively against (...) others. To be sure, he may not harm others, and he may, if necessary, be forced not to harm them, but he should never be forced to help them, as people are in fact forced to help others, according to Nozick, by redistributive taxation. The article examines the change of theoretical framework in analytic philosophy of mind. It is well known fact that nowadays philosophical problems of mind are frequently seen as incredibly difficult. It is noteworthy that the first programs of analytical philosophy of mind were skeptical about difficulty of that realm of problems. One of the most notable features of both those programs was the strong antimetaphysical stance, those programs considered philosophy of mind unproblematic in its nature. However, the consequent evolution of (...) philosophy of mind shows evaporating of that stance and gradual recovery of the more sympathetic view toward the mind problematic. Thus, there were two main frameworks in analytical philosophy of mind: 1) the framework of logical positivism and ordinary language philosophy dominated in the 1930s and the 1940s; 2) the framework that dominated since the 1950s and was featured by the critique of the first framework. Thus, the history of analytical philosophy of mind moves between two highly opposite understandings of the mind problematic. The article aims to found the causes of that move in the ideas of C. Hempel and G. Ryle, who were the most notable philosophers of mind in the 1930s and the 1940s. (shrink)

In this stimulating work of political philosophy, acclaimed philosopher G. A. Cohen sets out to rescue the egalitarian thesis that in a society in which distributive justice prevails, peopleâes material prospects are roughly equal. Arguing against the Rawlsian version of a just society, Cohen demonstrates that distributive justice does not tolerate deep inequality. In the course of providing a deep and sophisticated critique of Rawlsâes theory of justice, Cohen demonstrates that questions of distributive justice arise not only for the state (...) but also for people in their daily lives. The right rules for the macro scale of public institutions and policies also apply, with suitable adjustments, to the micro level of individual decision-making. Cohen also charges Rawlsâes constructivism with systematically conflating the concept of justice with other concepts. Within the Rawlsian architectonic, justice is not distinguished either from other values or from optimal rules of social regulation. The elimination of those conflations brings justice closer to equality. (shrink)

The twentieth century saw two fundamental revolutions in physics—relativity and quantum. Daily use of these theories can numb the sense of wonder at their immense empirical success. Does their instrumental effectiveness stand on the rock of secure concepts or the sand of unresolved fundamentals? Does measuring a quantum system probe, or even create, reality, or merely change belief? Must relativity and quantum theory just co-exist or might we find a new theory which unifies the two? To bring such questions into (...) sharper focus, we convened a conference on 'Quantum Physics and the Nature of Reality'. Some issues remain as controversial as ever, but some are being nudged by theory’s secret weapon of experiment. (shrink)

It seems to me that unforgiveably little attention has been paid in the program of our round table and in the discussion as it has developed to questions of socialization and, particularly, moral training.

The function of philosophy may be circumscribed as consisting in ma king a keen analysis of the peculiar nature of the crisis-situation, as it has existed among mell throughout th~ centuries of human history, and as it manifested itself in definite ways at the various stages of this his tory. That is to say, philosophy may be regarded as the discipline which, again and again, will have to determine the authenticity of man's ex istence in the light of the changing (...) conditions of life, i. e., man's chang ing needs and interests. Fundamentally, these needs may be regarded as being of a material, an intellectual, an aesthetical and a spiritual kind. On the grounds of the crisis, which inevitably exists among men on ac count of the controversial nature of their various truth-perspectives, as they are postulated on a personal level, in the sciences, in history, in the fine arts and in theology, man creates and re-creates the goods of civilization and the cultural values. The task of philosophy consists then in making an ever new assessment of man's changing needs, in terests and aspirations on the basis of the specific conflicts and prob lems with which man wrestles at a certain historical stage. It is in this way that the important philosophical systems were constructed, which we still admire to-day. (shrink)
